Terms of Service for Website Hosting

 

1. Acceptance of Terms

By registering and utilizing the website hosting services offered by ServerSP (“Company”), you (“Customer”) agree to be bound by these Terms of Service.

2. Description of Services

The Company provides website hosting services, which may include but are not limited to: disk space, bandwidth, emails, databases, and technical support.

3. Customer Obligations

3.1. The Customer is responsible for maintaining the security of their access credentials.

3.2. The Customer agrees to use the services in compliance with all applicable laws.

3.3. The Customer must not use the services for illegal purposes or for the transmission of illegal, defamatory, abusive, offensive, discriminatory material, or that violates third-party rights.

4. Acceptable Use

4.1. The use of services for illegal activities is prohibited, including but not limited to: hacking activities, virus distribution, fraud, phishing, and distribution of copyrighted material without permission.

4.2. The use of services to host adult content without the express consent of the Company is prohibited.

4.3. Spam and unauthorized mass emailing are strictly prohibited.

5. Payment

5.1. The Customer agrees to pay all fees associated with the services as agreed upon at the time of registration.

5.2. The Company reserves the right to change the prices of services, notifying the Customer 30 days in advance.

6. Term and Termination

6.1. These Terms of Service come into effect on the date of acceptance by the Customer and remain in effect until terminated by either party.

6.2. Either party may terminate this agreement with 30 days’ prior notice.

6.3. The Company may terminate this agreement immediately, without notice, if the Customer violates any term of this agreement.

7. Limitation of Liability

7.1. The services are provided “as is,” and the Company does not guarantee that the services will be uninterrupted or error-free.

7.2. Under no circumstances will the Company be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of or inability to use the services.

8. Indemnification

The Customer agrees to indemnify and hold harmless the Company, its directors, employees, and affiliates from any claim, damage, liability, loss, obligation, cost or debt, and expenses (including but not limited to attorney’s fees) arising from the Customer’s use of the services.

9. Modifications to the Terms of Service

The Company reserves the right to modify these Terms of Service at any time, with notice to the Customer.

10. Governing Law

These Terms of Service will be governed by and interpreted in accordance with the laws of New Brunswick. Any dispute arising from these Terms of Service will be submitted to the competent courts of New Brunswick, Canada.
